On October 27th,2025, Texas filed a lawsuit against Johnson and Johnson, as well as their child company, Kenvue, who are facing claims that state that “Acetaminophen, Tylenol’s active ingredient, is dangerous to unborn children and young children. Yet they hid this danger and deceptively marketed Tylenol as the only safe painkiller for pregnant women.” Ken Paxton, the Attorney General of this lawsuit, claims that using Tylenol leads to a higher risk of unborn children developing ADHD and or ASD.

This isn’t even the first time Tylenol has been caught with these allegations. In 2022, allegations were made that using Tylenol when pregnant yields a higher chance of ADHD (Attention Deficit Hyperactivity Disorder) and ASD (Autism Spectrum Disorder) in newborn children. These same allegations were also made in 2023 as well as 2024 against J&J and Kenvue, not by any states but by individual parents from various states, at the state and federal levels. In court, the allegations were all shot down due to insufficient evidence. Now that there is more evidence to prove the claims, Texas is the first state to file a lawsuit against Kenvue.

In 2023, J&J completely gave up all rights to Tylenol to Kenvue. This was even pointed out by Ken Paxton, but he claims that J&J did this so that they wouldn’t be sued; however, J&J denies these claims. Kenvue is claiming that there is still not enough legal merit and scientific support to 100% prove these claims. Currently, J&J and Kenvue are not just being sued by the government of Texas but also thousands of people who have allegedly used Tylenol when pregnant and have had children born with ASD and or ADHD.  This lawsuit will not cripple J&J financially, but it can ruin its reputation. This, if proven in court, could also potentially cause massive recalls of Tylenol, not just across Texas but the U.S. as a whole.
